On October 11, 2022, the U.S. Department of Labor (DOL) announced that it is proposing to do away with the existing independent contractor test that the Trump administration slipped into place in January 2021, in favor of a shift back to a more rigid “totality of circumstances” analysis. Additionally, many states (such as Illinois) along with the several federal agencies (including the National Labor Relations Board) continue to target employers who engage independent contractors.
Misclassification of a worker as an “independent contractor” under a plethora of employment and labor laws is a high-stakes issue for employers. Employers who utilize the services of anyone not on their payroll are rolling the dice if they have not properly vetted the classification of independent contractors.
